HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.11103 of 2017 Order:
This Writ Petition is filed challenging the registration of Crime No.3 of 2009 by the third respondent on the complaint lodged by the fourth respondent for the offences under Sections 10 and 11 (4) of the Andhra Pradesh (Scheduled Caste, Scheduled Tribes, Backward Classes) Regulation of Issue of Community Certificates Act, 1993. In view of the prima facie case, this Court sees that registration of crime is not improper. However, the third respondent shall continue the investigation only in accordance with law and file charge sheet as expeditiously as possible by duly complying with the provisions of the Code of Criminal Procedure, 1973, including Section 41-A thereof. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
