ORDER:
This contempt case is filed alleging wilful disobedience of order dt.03.12.2015 in W.P. No.39286 of 2015.
The learned counsel for the petitioner has admitted that before filing this contempt case, no notice has been issued to the respondent calling upon him to implement the order of this Court. Contempt proceedings being quasi criminal in nature, unless the alleged contemnor is called upon to implement the order of the Court, the
petitioner is not entitled to invoke the contempt jurisdiction of this Court. Hence, the contempt case is dismissed, however, with liberty to the petitioner to sensitize the respondent on the need to implement the order of this Court by way of a notice, and if he fails to comply with the order, the former is entitled to avail a fresh remedy.
As a sequel to dismissal of the contempt case, Contempt Application No.88 of 2016 shall stand disposed of as infructuous.
