HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.179 of 2016 ORDER:

This revision is preferred challenging the order dated 2301-2015 made in I.A.No.30 of 2015 in E.A.No.11 of 2014 in C.C.No.38 of 2007 on the file of the District Consumer Forum, Chittoor at Tirupathi, wherein the petition filed by the petitioner invoking the provisions under Section 27 of C.P. Act, 1986 to recall the arrest warrant issued against him was dismissed. Having heard the learned counsel for the petitioner, learned counsel for the respondent No.1 and the learned Public Prosecutor and having perused the material available on record, this Court is of the view that the revision can be disposed of with the following directions :

The interim order dated 23-11-2015 passed by this court staying the operation of N.B.Ws. is made absolute and the Forum concerned is directed to dispose of the case without insisting the presence of the petitioner herein. Accordingly, the Criminal Revision Case is disposed of. Consequently, Miscellaneous Petitions pending, if any, in this revision shall stand closed.
