HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.4133 of 2004 ORDER:

When this matter is taken up for hearing, none appeared for the petitioners even though the matter is listed under the caption of dismissal.

The petitioners are seeking a direction to the respondents to regularize their services as Secondary Grade Teachers with effect from 30.4.1996 and also to absorb them into regular aided vacancies.

The learned Government Pleader for School Education contended that the petitioners were not appointed in accordance with the rules, and when once the petitioners were not appointed as per the rules, the question of regularizing their services and absorbing them into aided services would not arise, and that there are no merits in this writ petition. 4.

This Court having considered the merits of the case is of the view that this writ petition can be disposed of directing the 4th respondent to submit fresh proposals to the competent authority, if the petitioners are working as on today. 5.

Accordingly, the Writ Petition is disposed of directing the 4th respondent to submit fresh proposals to the competent

authority, if the petitioners are working as on today, within a period of two weeks from the date of receipt of a copy of this order. Upon such proposals being sent, the competent authority shall consider and pass appropriate orders in accordance with the rules within a period of four weeks thereafter. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
