HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.3405 of 2013 ORDER :

This Criminal Petition is filed by the Petitioners/Accused Nos.1 to 5 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.165 of 2012 of Palakol Town Police Station, West Godavari District, registered for the offences punishable under Sections 420 and 406 r/w 34 IPC, which is outcome of report of 2nd respondent-de facto complainant.

2) When the matter came up for hearing, there is no representation on behalf of the petitioner and the respondent State represented by the Public Prosecutor submitted that the above calendar case was ended in acquittal after full dressed trial and no cause survives for adjudication in this criminal petition and the same has become infructuous.

3) Recording the said submission, this criminal petition is dismissed as infructuous. As a sequel, miscellaneous petitions pending, if any, in this criminal petition shall stand closed.
