HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Writ Petition No.445 of 2009 ORDER:

In this writ petition, the petitioners are seeking a writ in the nature of Mandamus declaring the action of the 6th respondent in interfering with the civil disputes between the petitioners and respondents 10 to 19 as arbitrary, highhanded and abuse of process of law and award compensation to the petitioners for their illegal acts and further direct the respondents to take appropriate action and consequently protect petitioners' peaceful possession and enjoyment of the property bearing H.No.9-151, Kacheri Veedhi, Sullurpet Village and Mandal, P.S.R.Nellore District. 2) Learned Government Pleader for Home, on instructions, would submit that there is a civil dispute in A.S.No.468 of 2000 on the file of High Court of Telangana and Andhra Pradesh, Hyderabad between the petitioners and respondents 10 to 19 with regard to property bearing H.No.9-151, Kacheri Veedhi, Sullurpet Village and Mandal, P.S.R.Nellore District and the respondents-police never interfered with the civil disputes of the petitioners herein.

3) In W.P.M.P.No.533 of 2009, this Court passed interim order dated 25.06.2009 directing respondent No.6 and his subordinates not to interfere in the civil disputes between the petitioners and respondent Nos.8 and 9 in respect of H.No.9-151, Kacheri Veedhi, Sullurpet Village and Mandal, P.S.R. Nellore District. It is to be noted respondent Nos.10 to 19 were added in the writ petition subsequently.

3) Be that it may, in view of submission of learned Government Pleader that respondents never interfered with the civil disputes between the petitioners and respondents 10 to 19 and also in view of the interim order, there is no need to pass any final order in the writ petition. 4) Accordingly, this Writ Petition is closed. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
