HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24474 OF 2018 O R D E R :

This writ petition is filed for a writ of Mandamus declaring the action of respondent Nos.1 to 3 in not entrusting the investigation of FIR No.85/2018, dated 31.05.2018 on the file of the Bonakal Police Station, Khammam District, to the CBCID, inspite of written representation dated 05.06.2018, as illegal and arbitrary. Learned counsel for the petitioner states that basing on the complaint received from 8th respondent who is a politically motivated person, a case in Crime No.85/2018 is registered. Learned Counsel for the petitioner tried to argue the matter stating that registration of crime itself is illegal and seeks stay of all further proceedings in the said crime. But, he has not challenged the registration of crime nor sought for quashing of the said FIR in the writ petition. More so, the petitioner has not made any ground for invocation of jurisdiction under Article for transferring the investigation from regular police to CBCID.

In view of the same, I do not see any reasons to entertain the writ petition.

Accordingly, the writ petition is dismissed. However, it is open fro the petitioner to challenge the said FIR. No order as to costs.
