THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8126 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A1 in Crime No.121 of 2022 on the file of E Bayyaram Police Station, B.Kothagudem District, registered for the offences punishable under Section 20(b) read with 8(C) of the NDPS Act, 1985.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that the petitioner along with others was found in possession of 3.19 Kgs. Bayyaram Police and was remanded to custody on 10.07.2022. 4.

On instructions, the learned Assistant Public Prosecutor submits that there are no other cases pending against the petitioner.

Since the contraband seized is less than commercial quantity and since there are no other questionable

antecedents against this petitioner, this petitioner can be granted the relief of bail subject to the following conditions: i) The petitioner/A1 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to the satisfaction of Special Sessions Judge for the Trial of Cases under Narcotic Drugs and Psychotropic Substances Act-cum-I Additional Sessions Judge at Kottagudem.

ii) After release, the petitioner/A1 shall appear before the concerned Station House Officer, on every Monday and Thursday between 10.30 A.M. to 1.00 P.M., for a period of six weeks, for the purpose of investigation. iii) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
