THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.6756 OF 2016

O R D E R

The prayer of the petitioner in this case is as under: 'It is therefore prayed that this Hon'ble Court be pleased to issue an appropriate writ, order or direction preferably a Writ in the nature of Mandamus declaring the action of the respondents in not according permission to renovate the petitioner's Church despite the petitioner's representation dt. 26.10.2015 submitted to the 2nd respondent by paying requisite fee of Rs.10000/- along with plan and keeping it pending before it as illegal, arbitrary and in violation of Article 300-A of the Constitution of India and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'

Smt. Pingali Lakshmi, learned standing counsel for Warangal Municipal Corporation, produced rejection memo dated 05.11.2015 issued by the Warangal Municipal Corporation, whereby the petitioner's application for renovating the Church was rejected. A copy of the memo is also placed on record. In the light thereof, the cause in this writ petition no longer survives for consideration. The writ petition is dismissed leaving it open to the petitioner to work out his remedies against the rejection memo dated 05.11.2015 in accordance with law, if he so chooses. Pending miscellaneous petitions shall also stand dismissed in the light of this final order. No order as to costs.
