THE HONOURABLE SRI JUSTICE A.V.SESHA SAI W.P.No.13950 of 2015 Order :

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief :

" Hon'ble Court may be pleased to issue an appropriate writ, order or directions more particularly one in the nature of Writ of Mandamus, declaring the inaction of the respondents in not considering the representation dated 6.8.2014 submitted by the petitioner and not providing the protection to the petitioner and his witnesses in S.C.No.42 of 2008, to enable to appear before the learned Spl. Sessions Judge for Trial of SC/ST's (POA) Act, 1989 at Nalgonda, T.S. for adducing evidence as illegal, arbitrary and violation of the Articles 14 & 16 of the Constitution of India and contrary to the provisions of SC/ST's (POA) Act, 1989 and consequently direct respondents to provide necessary protection to the petitioner and his witnesses in S.C.No.42 of 2008, to enable to appear before the learned Spl. Sessions Judge for the Trial of SC/ST's (POA) Act., 1989 at Nalgonda, T.S. for adducing their evidence on every hearing dates and pass such other order or orders."

The only grievance in this writ petition is as regards alleged inaction on the part of the respondents in not providing police protection to the petitioner herein.

When the matter is taken up today, written instructions dated 4.6.2015 furnished by the Sub Inspector of Police, Bhongir Rural Police Station, Nalgonda District to the office of the learned Government Pleader for Home have been placed on record by the learned Government Pleader for Home. In the said instructions dated 4.6.2015, it is stated that " as and when the petitioner requires police

protection for attending trial, the respondent police will give protection to the petitioner."

In view of the above, learned counsel for the petitioner requested the Court to dispose of the writ petition by recording the said instructions dated 4.6.2015 furnished by the Sub Inspector of Police, Bhongir Rural Police Station, Nalgonda District.

In the circumstances, the writ petition is disposed of recording the above mentioned written instructions dated 4.6.2015 furnished by the Sub Inspector of Police, Bhongir Rural Police Station, Nalgonda District. No costs. Miscellaneous petitions pending, if any, shall stand closed.
