HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41510 of 2016 ORDER:
The present writ petition is filed by the petitioner under Article 226 of the Constitution of India, seeking to declare the action of the 3rd respondent in taking steps to conduct thorough enquiry into Cr.No.157 of 2016, as illegal and arbitrary, and consequently, direct the 3rd respondent to conduct investigation into the above crime and take appropriate action.
Heard and perused the material available on record. The main grievance of the petitioner is that she lodged a compliant against the 4th respondent, who is her daughter-in-law, and the family members of the 4th respondent, alleging that her son committed suicide, for which the 4th respondent and her family members are responsible, and basing on the said complaint Crime No.157 of 2016 is registered, but the 3rd respondent did not choose to conduct investigation in the matter.
Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the 2nd respondent is directed to conduct investigation in the above crime, complete the same and file a final report, as expeditiously as possible.
With the above directions, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
