HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.23886 of 2011 ORDER:

As there was no representation on behalf of the petitioners on 15.09.2015, the matter was directed to be listed to today under the caption "for dismissal". Even today also there is no representation on behalf of the petitioners either in the morning or in afternoon session. Hence, heard learned Government Pleader for Revenue, Government Pleader for Home, learned counsel appearing for the fourth respondent and perused the record. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not allowing the first petitioner to perform the last rites of his mother Koraganti Koteswaramma, who died on 22.08.2011 by taking only available route ie. the Z.P.

road of VuyyuruGannavaram to reach the burial ground as illegal, inhuman and violative of fundamental rights guaranteed under Constitution of India; and consequently direct the respondents to permit the petitioner to perform the last rites of Koraganti Koteswaramma by taking funeral procession on the Z.P. road; and also direct the respondents to take steps to solve the problem by giving sufficient protection.

As seen from the record, the relief sought for is to allow the funeral procession of Koraganti Koteswaramma on Z.P. road of Vuyyuru-Gannavaram to reach the burial ground. By an order dated 24.08.2011, this Court directed the third respondent to provide adequate police protection to the first petitioner and also

to his family members while carrying the dead body in procession to the burial ground.

In view of the above and as there is no representation on behalf of the petitioners, this Court is of the view that the cause in the writ petition does not survive and no further orders need be passed.

Accordingly, the writ petition is closed. There shall be no order as to costs.

Miscellaneous Petition, if any, pending in this Civil Revision Petition, shall stand closed.
