Heard Mr.A.Ravi Shankar for petitioner and the learned Assistant Government Pleader for respondents. The petitioner challenges order of Revenue Divisional Officer D.Dis.No.676/ 2017 dated 24.11.2017 as illegal, arbitrary and violative of principles of natural justice.
On representation filed by 4th respondent, notice No.676/ 2017 dated 20.11.2017 is served on the petitioner. Notice adverts to the date of enquiry as 28.11.2017 at 11.00 A.M. before the Revenue Divisional Officer, Tekkali. As already noted, the 2nd respondent passed order on 24.11.2017 i.e. much earlier to the date on which the enquiry is scheduled.
The Assistant Government Pleader, on instructions, submits that the proceedings impugned in the writ petition are unsustainable. The statement is placed on record and the proceedings are set aside.
Mr.Ravi Shanker requests four weeks time to file representation to notice dated 20.11.2017. Time as prayed for is granted. The petitioner is given liberty to raise all objections including the maintainability of representation before the 2nd respondent in the reply the petitioner proposes to file. As and when the enquiry in to the matter is taken up, the 2nd respondent is under obligation to consider each one of the objections and record his findings.
The writ petition is ordered as indicated above. No order as to costs.
