THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37579 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed to declare the action of the respondent authorities in not taking any steps to protect the lands belonging to the Neelayamma Choultry, situated at Dakamarri Village, Padmanabham Mandalam, Visakhapatnam District, in spite of the representations followed by legal notice, dated 11.06.2016, as illegal and arbitrary. Heard and perused the material available on record. The case of the petitioner is that in the year 1974, the Endowments Department took over the possession of Sri Neelayamma Choultry, situated at Dakamarri Village, Padmanabham Mandalam, Visakhapatnam District, and in the year 2002, the petitioner was appointed as Ex-President to the said Choultry and that vide proceedings, dated 30.05.

2002, the petitioner got surveyed the lands of Neelayamma Satram and during the course of survey, it has been noticed that the lands admeasuring Ac. 427.09 cents were under illegal occupation and cultivating the lands by farmers of Botsapeta, Buddivalasa and Lingampeta and that the petitioner has submitted a representation to the respondent authorities on 11.06.2016 to take steps to protect the lands belonging to Neelayamma Choultry. The main grievance of the petitioner is that though the petitioner has submitted a representation to the respondent authorities, dated 11.06.2016, but the respondent authorities are not taking any steps to protect the lands belonging to Neelayamma Choultry from encroachment.

and to pass appropriate orders by the respondent authorities, the writ petition is disposed of with the following direction: The respondent authorities are directed to consider the representation, dated 11.06.2016, submitted by the petitioner, and dispose of the same, in accordance with law, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
