This appeal is filed under Order XLIII Rules 1 and 2 of C.P.C. assailing the order dated 07.11.2005 passed in P.O.P.No.247 of 2005 on the file of the Motor Vehicles Accident Claims Tribunalcum-VII Additional District Judge (Fast Track Court), Krishna at Vijayawada.

Learned counsel for the appellant submitted that the purpose of filing the appeal has become infructuous. In view of the submission made by the learned counsel for the appellant, the Civil Miscellaneous Appeal is dismissed as infructuous. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Appeal shall stand closed.
