HON'BLE SRI JUSTICE CHALLA KODANDA RAM WIRT PETITION No.14573 OF 2015 ORDER:

This Writ Petition is filed seeking Writ of mandamus to declare the proceedings in Lr.No.DEE/OTPG/AE.Comml./F.

/D.No.439/15, dated 20.04.2015 issued by the respondent No.3 as illegal and ultra virus to the provisions of the Article 14 of the Constitution of India.

It is the petitioner's case that the petitioner is eligible for supply of free power in terms of the tariff order for the financial year 2015-2016 to his agricultural farm. The authorities have rejected the application of the petitioner on the ground that as per the clarification from their higher authorities the petitioner is not eligible to have free supply of power to his agriculture service connection No.273/Cat-V under HUF capacity.

Inasmuch as, the petitioner seeking agricultural electricity connection, this Writ Petition can be disposed of giving liberty to the petitioner to approach the respondent authorities and seek agricultural electricity service connection and the same shall be considered by the respondent authorities within eight weeks from the date of filing of the application, subject to the condition of petitioner satisfying the criteria for supply of free power to the agricultural connection. Since the rejection order is in relation to HUF capacity, this order shall not come in the way of considering the petitioner's case in his individual capacity subject to his satisfying the criteria.

Accordingly, the Writ Petition is disposed of. As a sequel,

pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
