THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8136 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.3 in Crime No.500 of 2022 pending on the file of Station House Officer, S.R. Nagar Police Station, Panjagutta Division, Hyderabad registered for the offence punishable under Section 8(c) read with Section 22(C) and 27 of Narcotic Drugs and Psychotropic Substance Act, 1985.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The facts of the case are that the S.R.Nagar Police arrested this petitioner and others for being in possession of MDMA drug. Specifically, the case against this petitioner is that he was found in possession of 10 grams of MDMA Drug.

Learned Counsel for the petitioner submits that the petitioner is languishing in jail since 11.07.2022 and that the allegations leveled against the petitioner are false.

Learned Assistant Public Prosecutor would submit that there are no cases pending against this petitioner. He also submits that the charge sheet is already filed after completion of investigation. 6.

Keeping in view that investigation is already complete and charge sheet is filed, the petitioner can be granted the relief of bail. 7.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.3 is granted bail subject to the following conditions:

i) The petitioner/Accused No.3 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of III Additional Chief Metropolitan Magistrate at Hyderabad.

ii) The petitioner/Accused No.3 shall appear before the concerned Court on every date of hearing before the trial Court without fail.

iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 22.09.2022 ns
