HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.3011 of 2012 O R D E R :

Heard learned counsel appearing for the petitioners and the learned Government Pleader for Assignment appearing for respondent Nos.1 to 3.

2. Both the petitioners are assignees of certain extents of lands situated at Battamdoddi Village, Peddapanjani Mandal, Chittoor District. Alleging that the said lands have been assigned in favour of the 4th respondent for consideration, orders were passed by the 2nd respondent on 15.01.2011 cancelling the assignments in their favour. The petitioners filed appeals before the Commissioner of Appeals, O/o. the Chief Commissioner of Land Administration, Andhra Pradesh, Hyderabad, which were numbered as BCW2/111/2011 and BCW2/112/2011, respectively. The said appeals are stated to be pending before the said authority even today. Apprehending that respondent Nos.1 to 3 might alienate the lands, which are the subject matters of these appeals, pending disposal of the said appeals by the Commissioner of Appeals, this writ petition has been filed.

Counter affidavit has been filed by the 3rd respondent, on behalf of respondent Nos.1 and 2, stating that since the matter is pending before the Commissioner of Appeals, respondent Nos.1 to 3 would not alienate the properties to the third parties and that the writ petition was filed only on the basis of an apprehension.

4. Having regard to the stand taken by respondent Nos.1 to 3, this writ petition is disposed of directing respondent Nos.1 to 3 not to alienate the properties, which are subject matters of the above

appeals pending before the Commissioner of Appeals, O/o. the Chief Commissioner of Land Administration, Andhra Pradesh, Hyderabad, till disposal of the said appeals and the Commissioner of Appeals is directed to dispose of the said appeals within a period of twelve weeks from the date of receipt of a copy of this order.

5. As a sequel, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. _____________________________ M.S. RAMACHANDRA RAO, J 06.06.2016.
