HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION NO. 5886 OF 2008 O R D E R:

This Writ Petition was field challenging the notification dated 20.11.2007 issued under Section 4(1) of the Land Acquisition Act, and the declaration dated 1.3.2008.

This Court by order dated 19.3.2008 directed that the respondents shall not take any coercive steps with regard to the possession of the property of the petitioner.

Initially, counter affidavit was filed by the respondent and an additional counter affidavit was also filed on 21.4.2015 stating that after publishing the draft declaration, the land owners filed five Writ Petitions against acquisition proceedings and obtained stay orders and for that reason the further acquisition proceedings were held up and the present Writ Petition is one among them. Though an amount of Rs. 3,31,00,000/- was deposited by the Requisitioning Department, the Executive Engineer, R.W.S & Sub Division, Gudivada in his letters dated 5.5.2014 and 26.3.2015 informed that the Engineer in chief, RWS & S Division, Hyderabad, issued instructions for withdrawal of Land Acquisition

proposals for the work CPWS Scheme to Mudinepalli and 74 other habitations as the administration sanction of the work is lapsed. The Executive Engineer further reported that the land under acquisition is not required at present and the deposited amount towards cost of land acquisition may be refunded.

In view of the said statement, no further orders are necessary in this Writ Petition.

Accordingly, the Writ Petition is disposed of recording the statement of the respondents. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
