This Civil Revision Petition is filed by the petitioner/ plaintiff, challenging the order, dated 20.11.2019, passed by the Principal Senior Civil Judge, Ranga Reddy District at L.B.Nagar, returning the plaint submitted by the petitioner/ plaintiff holding that it has no territorial jurisdiction to entertain the unnumbered suit.

Heard the learned counsel for the petitioner/ plaintiff and perused the record.

The learned counsel for the petitioner/ plaintiff would submit that the trial Court returned the plaint with an office endorsement that it has no territorial jurisdiction to entertain the unnumbered suit, which is erroneous. There is material to substantiate that the Court below has jurisdiction to entertain the unnumbered suit and ultimately prayed to set aside the order of return of plaint and consequently direct the Court below to register the unnumbered suit.

It is evident from the material placed on record that the subject O.S.S.R.No.17210 of 2019 was not called on bench and the point of jurisdiction was not determined, after hearing the counsel on record. The plaint was returned with an office endorsement that Thalakondapally Mandal does not fall under the territorial jurisdiction of the Court below.

Under these circumstances, the learned Principal Senior Civil Judge, Ranga Reddy District at L.B.Nagar, is directed to call the matter on bench and determine the point with regard to the jurisdiction to entertain the unnumbered suit. 6 .

With the above direction, this Civil Revision Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this CRP, shall stand closed.
