THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 26731 of 2014 O R D E R :

This Writ Petition is filed alleging that the respondent - police are interfering with the civil disputes between the petitioner on the one hand and the 4th respondent on the other. This Court, while issuing notice before admission, on 11.09.2014, directed the 3rd respondent - Station House Officer, Tekulapalli Police Station, Khammam District not to interfere in any civil disputes pending between the petitioner and the 4th respondent. The 4th respondent had taken out an Application seeking vacation of the said order.

Learned Assistant Government Pleader for Home appearing on behalf of Respondents 2 and 3 would submit that as a matter of fact, there is no interference by the official respondents in the civil litigation of the parties, the allegation made by the petitioner is false and that the police are unnecessarily implicated in this matter.

In the light of the submissions made by the learned Assistant Government Pleader, the Writ Petition is closed leaving it open to the petitioner as well as the 4th respondent to work out their remedies in the civil proceedings i.e. O.S.No. 142 of 2013 and O.S.No. 226 of 2014 on the file of the Special Assistant Agent & Sub-Divisional Magistrate (Mobile Court), Bhadrachalam. It is made clear that the respondent - police shall not interfere with the civil disputes between the petitioner and the 4th respondent with respect to the subject property of the suit.

Consequently, the miscellaneous Applications, if any shall stand closed.
