THE HONOURABLE Dr.JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.1169 of 2017 ORDER :

This Criminal Revision Case is filed by the petitioner/ accused against the order dated 23.03.2017 passed by the VII Metropolitan Magistrate-cum-II Additional Junior Civil Judge, Bheemunipatnam, in Crl.M.P.No.2397 of 2016 in C.C.No.153 of 2016 filed to discharge the accused for the charge framed against him under Section 292 I.P.C., Heard before admission the learned counsel for the petitioner and the learned Public Prosecutor for the State.

Admittedly, as pointed out by the learned Public Prosecutor, Section 239 Cr.P.C. has no application.

Hence, this Criminal Revision Case is disposed of, with liberty to the petitioner to file proper application under Section 251 r/ w 258 Cr.P.C. to consider on its own merits and submit before the trial Court, the decisions, which were brought before this Court, for its consideration.

Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions, if any, pending shall stand closed.
