HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.1798 of 2015 in Crl.P.No.1663 of 2015 and Criminal Petition No.1663 of 2015 COMMON ORDER:
T h e defacto complainant-Kotagiri Gopala Rao reported died on 13.09.2014 and the victim-Gangireddy Nagamani, the daughter of defacto complainant is present and her counsel Sri Ghantasala Udaya Bhaskar are present. A.1 and his counsel Sri Narasimha Rao Gudiseva are present.
Heard both sides and perused the petition.
On the report given by defacto complainant, the Police of Avanigadda P.S, registered Crime No.73 of 2012 against A.1 to A.4 and laid charge-sheet for the offences under Sec.498-A, 306 r/w 511 IPC and the matter is pending as PRC No.35 of 2012 on the file of Additional Judicial First Class Magistrate, Avanigadda for committal.
At this stage, the victim-Nagamani and A.1 and their Counsel attended the Court and submitted that at the intervention of elders they have amicably resolved their disputes as per which they have been living together peacefully and therefore, the victim has no objection for quashment of proceedings and hence permission may be accorded to them to compound the offence and quash the proceedings in the interest of justice.
Having regard to the above said submission and in view of the fact that the matter is a matrimonial dispute and the parties have amicably resolved their differences and no useful purpose will be served even if they are driven to trial and following the decision reported in Gian Singh v. State of Punjab and another[1], this petition is allowed and permission is accorded to the parties to compound the offence and consequently proceedings in PRC No.35 of 2012 (Crime No.73 of 2012 of Avanigadda P.S) on the file of Additional Judicial First Class Magistrate, Avanigadda are hereby quashed as per the compromise memo filed by the parties.
In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
