HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.33040 of 2016 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the respondent Nos.2 to 4 in considering the representation of the petitioner as illegal and arbitrary. Heard the learned counsel for the petitioner, the learned Government Pleader for Irrigation and the learned Government Pleader for Revenue.
The petitioner claims that he is the owner of an extent of Ac.3-09 guntas in Sy.No.92-C and Ac.0-15 guntas in Sy.No.92-B of Korukondapalli village, Kesamudram Mandal, Warangal District. It is further submitted that there is a kunta in an extent of Ac.0-15 guntas in Sy.No.92 by the side of the land of the petitioner. The respondents are winding the kunta under Mission Kakatiya Programme. The grievance of the petitioner is that the respondents are dumping waste material in his land. The petitioner submitted a representation to the respondent Nos.2 to 4 on 02.08.2016 to pay compensation to him. But, for one reason or the other, the respondents have not disposed of the representation of the petitioner so far.
At the time of arguments, the only relief sought by the learned counsel for the petitioner is to direct the respondent Nos.3 to consider the representation submitted by the petitioner on 02.08.2016 and pass appropriate orders. The learned standing counsel also consented for the same.
In view of the submissions made by both counsel, this Court is not inclined to go into the merits of the main case. Having regard to the facts and circumstances of the case and also the submissions made by both counsel, the third respondent is hereby directed to consider the application of the petitioner dated 02.08.2016 in accordance with law, as expeditiously as possible, preferably, within six weeks from the date of receipt of a copy of this order.
With the above direction, this Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed. _________________________ T. SUNIL CHOWDARY, J Date: 28th September, 2016 Kvsn
