THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 10060 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/A2 seeking bail in the event of his arrest in connection with Crime No.70 of 2023, on the file of Kanchan Bagh Police Station, for the offences punishable under Sections 312, 376(2)(n), 354, 354-A, 354-C, 323, 506 of the Indian Penal Code, 5(I) r/w.6, 9 r/w.10, 19 r/w.21 of the POCSO Act, 2012 and Section 67-A of the IT Act. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record. 3.

The Police have filed charge sheet showing this petitioner and Accused No.3 as absconding. She is arrayed as Accused No.2. The allegation against Accused No.1 is that he has committed rape on his daughter. After she became pregnant, it is alleged that this petitioner along with Accused No.3 suggested for abortion and taken her to a hospital.

Apart from the said allegation, there is no allegation against this petitioner. Further, this Court on 05.10.2023 granted Anticipatory Bail to Accused No.3 in Crl.P.No.9596 of 2023. In the said circumstances, this Court deems it appropriate to grant the relief of Anticipatory bail to this petitioner/A2, subject to the following conditions:

1) The petitioner/A2 is directed to surrender before the Station House Officer, Kanchanbagh Police Station, Hyderabad, on or before 19.10.2023. On such surrender, the said Station House Officer shall release the petitioner/A2 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/A2 shall appear before the concerned Station House Officer, as and when required for the purpose of investigation.

3) The petitioner/A2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
