Heard Mr.N.Ashok Kumar for petitioner.

Defendant No.1 in O.S.No.96 of 2010 in the Court of the Senior Civil Judge, Peddapalli is the revision petitioner. The revision petitioner filed I.A.No.408 of 2018 under Order VIII Rule 1A (3) of CPC for receiving unregistered sale deed.

The averments, in brief, for receiving the unregistered sale deed are that the petitioner presented the unregistered sale deed before the Revenue Divisional Officer for impounding and so far the said document is not impounded. The 1st respondent/ plaintiff objected to the prayer for receiving the document, for the said document, without registration, is inadmissible. The learned trial Judge rejected the prayer for receiving the unregistered sale deed observing that the petitioner filed the document at a belated stage and cannot be received in evidence and that the plaintiff's side evidence is completed. Hence, the revision.

I have perused the record. The trial Court has rightly dismissed the application filed by the petitioner. This Court is in agreement with the reasons stated by the trial Court. No ground warranting interference under Article 227 of the Constitution of India is made out.

Revision fails and is, accordingly, dismissed. There shall be no order as to costs.
