THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION NO. 3494 OF 2012 ORDER:

This civil revision petition is filed under Article 227 of the Constitution of India, challenging the order passed in I.A.No.637 of 2012 in O.S.No.127 of 2012 dated 16.04.2012, dismissing the petition filed for appointment of Advocate Commissioner on various grounds.

During hearing Sri J. Janaki Rami Reddy, learned counsel for the revision petitioners reiterated the contentions while contending that the Court can mould the relief appropriately and requested to appoint a Mandal Surveyor as a Commissioner to measure the suit schedule property and at the end, the learned counsel requested withdraw the revision petition with a liberty to file fresh application with appropriate relief. Recording the request of the learned counsel for the revision petitioners, the civil revision petition is dismissed without touching the merits of the order under challenge, granting liberty to renew the request with appropriate application under Order XXVI Rule 9 C.P.C.

Consequently, miscellaneous applications, pending if any shall also stand closed. No costs.
