HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6732 2015 ORDER:
This Criminal Petition is filed by the petitioner/A1 under Section 482 Cr.P.C seeking to quash the proceedings in crime No.300 2014 of Chilakalguda Police Station, Hyderabad, registered for the offence punishable under Sections 468, 471, 420 I.P.C. and 156(3) Cr.P.C.
Heard the learned counsel for the petitioner and the learned Public Prosecutor (Telangana) for the State before notice to respondent No.2/de facto complainant and before admission. Perused the material on record. The sum and substance of the accusation is that the complainant entrusted being a contractor to produce the certificate along with his application for tender, which certificate he asked A1 to secure from an Engineering College and A1 secured from the Vasavi Engineering College that was issued by A3, who is retired officer of said Engineering College and it is the contention that there is nothing to say that A1 forged the certificate much less used the same with the knowledge of certificate forged but for at best from the complainant secured and thereby he is innocent and the F.I.R. is liable to be quashed.
Learned Public Prosecutor submits that the investigation is in progress. As the material, falls short to admit the application under Section 482 Cr.P.C. but the factual matrix entitled to the concession of bail, this application is disposed of giving liberty to the petitioner to surrender before the learned Magistrate and move for regular bail with notice to Assistant Public Prosecutor and in such an event the learned Magistrate shall hear and grant bail on the same day with necessary conditions. Needless to say, at the post bail stage pending investigation, the presence of the petitioner before the Court can be dispensed with. In the event of police filing final report or any cognizance taken by the Magistrate, further remedy is left open to the petitioner.
Accordingly, this Criminal Petition is disposed of.
