THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION Nos.8148 OF 2022 AND COMMON ORDER:

These Two Criminal Petitions are filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioners who are arrayed as Accused Nos.1 to 3 in the event of their arrest in Crime No.236 of 2021 on the file of Station House Officer, Mahabubabad Town Police Station, Mahabubabad District registered for the offences punishable under Sections 498-A, 379, 506, 509 and 307 read with Section 34 of Indian Penal Code and Section 156(3) of Cr.P.C.

As the petitioners in both the criminal petitions are Accused in the same Crime i.e. Crime No.236 of 2021, both the criminal petitions are heard together and disposed off by this common order. 3.

Heard learned counsel for the petitioners/Accused Nos.1 to 3 and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

A private complaint was filed by the de facto alleging that she was married to the Accused No.1 on 19.08.2018 and at the time of marriage dowry was also given, subsequently there was allegation of demand for additional dowry and unable to bear the harassment she left the house. The said complaint was registered on 16.09.2021. 5.

In the said circumstances since the allegations made in the complaint are due to the matrimonial discord of Accused No.1 and the de facto complainant, the petitioners can be granted the relief of anticipatory bail.

Accordingly, these two Criminal Petitions are allowed and the petitioners/Accused Nos.1 to 3 shall be enlarged on bail in the event of their arrest subject to the following conditions: i) The petitioners/Accused Nos.1 to 3 are directed to surrender before the Judicial First Class Magistrate at Mahabubabad within one week from today, and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) each with two sureties to the like sum each, to its satisfaction.

ii) The petitioners/Accused Nos.1 to 3 shall appear before the investigating authorities as and when required for the purpose of investigation.

iii) The petitioners/Accused Nos.1 to 3 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
