HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.8188 OF 2019 ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure seeking quashing of the proceedings in C.C.No.730 of 2019 on the file of the PJCJ-cum-VIII Additional Metropolitan Magistrate, Cyberabad at Kukatpally. charge sheet came to be filed against the petitioner/accused for the offence punishable under Section 354-D of the Indian Penal Code.
Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioner/accused restricts his prayer seeking dispensation of the presence of the petitioner/accused before the trial Court on every date of adjournment.
The learned Public Prosecutor submits that since the identity of petitioner/accused is not in dispute, his presence in the above C.C. may not be necessary on every date of adjournment. Having regard to the facts and circumstances of the case, the personal appearance of the petitioner/accused in C.C.No.730 of 2019 on the file of the PJCJ-cum-VIII Additional Metropolitan Magistrate, Cyberabad at Kukatpally, is hereby dispensed with except on the dates when his presence is specifically required by the Court.
With the above direction, the Criminal Petition is disposed of.
Miscellaneous applications, if any, pending shall stand closed.
