THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 7374 OF 2018 ORDER:

This petition is filed under Section 482 of the Code of Criminal Procedure by the petitioners-accused Nos. 15 and 17 to quash the proceedings in crime No. 60 of 2017 of Duttaluru Police Station, S.P.S.R. Nellore District, registered for the offences punishable under Sections 420, 409 and 120-B read with Section 34 of IPC.

At the hearing, learned counsel for the petitioners submitted that this Court by common order dated 29-11-2017 in Criminal Petition Nos. 9389 of 2017 and batch quashed the proceedings in the above crime insofar as accused Nos. 1, 2, 9, 18 and 19 are concerned on the ground that the order passed by the Project Director, District Water Management Authority, on the basis of which the above crime was registered, was not in existence in view of the order dated 08-09-2017 passed by this Court in W.P.No. 28828 of 2017 and that these petitioners also stand on the same footing as that of accused Nos. 1, 2, 9, 18 and 19.

In the light of the common order dated 29-11-2017 in Criminal Petition Nos. 9389 of 2017 and batch, this criminal petition is also allowed and the proceedings against the petitioners-accused Nos. 15 and 17 in crime No. 60 of 2017 of Duttaluru Police Station, S.P.S.R. Nellore District, are quashed with a direction that the reasons and directions contained in the common order shall form part of this order. Pending miscellaneous petitions, if any, in this criminal petition shall stand closed in consequence.
