THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.11199 of 2025 ORAL ORDER:

This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.2 and 3 in connection with FIR dated 24.06.2025 in Crime No.207 of 2025 before Huzurabad Police Station, Karimnagar District, registered for the offences punishable under Sections 318(4), 336(1), 338, 336(3) read with Section 3(5) of BNS.

The case of the prosecution is that on 24.06.2025, the de-facto complainant lodged complaint before the Police stating that he had completed his degree and was currently working in a photo studio. His father, a retired government employee, was approached by Satyanarayana Reddy of Huzurabad, who claimed his friend Praveen (A1) could secure a job for the complainant in the electricity department (NPDCL). On 12.06.2025, A1 instructed the complainant to meet at Huzurabad School Ground with educational certificates. There, he met three others Akhil, Suresh, and

Venugopal, who also seeking job appointments. Praveen, along with Sanjeev and Veeresh (A2 & A3), directed them to Ramagundam and later to Godavarikhani, where A1 collected their documents and Rs.500/- each, claiming their jobs were confirmed. They were given biodata forms and told to pay Rs.5,00,000/- as service charges upon receiving official appointment orders by post. A1 assured them that many had secured jobs through A2 and A3, and warned them not to disclose the arrangement. Upon verification, the appointment order was found to be fake. Further investigation revealed that the accused had similarly defrauded others with false promises of jobs in Electricity, Forest, and NTPC departments, and had prior criminal cases registered against them. On receipt of the said complaint, a case was registered against the accused, including petitioners, for the offences as alleged. Aggrieved thereby, this Criminal Petition is filed seeking anticipatory bail of the petitioners.

Heard Sri Ramprasad Pathipaka, learned counsel for petitioners, and Sri Arun Kumar Doddla, learned Additional Public Prosecutor, appearing for respondent - State.

Learned counsel for petitioners submitted that the allegations leveled against the petitioners are nothing but an abuse of the process of law. He asserted that the petitioners are innocent of all the offences alleged, and, in fact, the de facto complainant admitted that A1 alone made statements implicating A2 and A3 (the petitioners) and that clearly indicates a malicious prosecution and false implication of the petitioners, with no specific role attributed to them.

Therefore, he prayed the Court to allow the criminal petition, granting the relief of anticipatory bail to the petitioner. 5.

On the other hand, the learned Additional Public Prosecutor, vehemently, opposed the submissions made by learned counsel for petitioner, and submitted that the allegations against the petitioners are of a serious nature, as they, along with A1, not only assured job placements but also fabricated fake appointment orders and further submitted that the petitioners cheated the de-facto complainant and others. As such, he prayed the Court to dismiss the criminal petition.

Having regard to the rival submissions made and upon perusal of the material placed on record, it is noted that A1 informed the de-facto complainant that A2 and A3 had previously assisted many individuals in securing government jobs. The petitioners, neither directly nor indirectly, contacted the de-facto complainant. According to the complainant, he paid Rs.500/- to A1, who then handed over the purported appointment order. While the complainant alleged that the petitioners had cheated many individuals, the prosecution has confirmed that no other cases are currently pending against them. In view of the above, this Court deems it appropriate to grant pre-arrest bail to the petitioners, subject to compliance with the following conditions:

i.

The petitioners shall surrender before the Station House Officer, Huzurabad Police Station, Karimnagar District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail, on petitioners executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
