THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2754 OF 2015 ORDER:
This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking grant of anticipatory bail in connection with crime No.101 of 2015 on the file of the III Town Police Station, Visakhapatnam, registered for the offences under Sections 376(1), 417, 420 read with Section 34 IPC and Section 4 of the Dowry Prohibition Act.
Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.
The brief facts of the case are as follows. There was a marriage proposal between the petitioner and the victim girl by the elders of the family and therefore, they decided to proceed with the marriage also. On the said proposal, the petitioner has sexual relationship with the victim girl.
Subsequently, due to some misunderstanding, they could not able to proceed with the marriage. Hence, the complaint is lodged against the petitioner.
Having regard to the facts and circumstances of the case and the nature of allegations against the petitioner, this Court is inclined to grant anticipatory bail to the petitioner herein.
In the circumstances, the petitioner/A.1 is directed to surrender before the Magistrate concerned within a period of fifteen days from today and on such surrender, he shall be enlarged on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum to the satisfaction of the said Magistrate. Further, the petitioner/A.1 is directed to report before the Station House Officer concerned as and when required. The Criminal Petition is accordingly disposed of. _________________________
