HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 40173 of 2016 ORDER:

The case of the petitioner is that she made a representation on 05.11.2015 to the 3rd respondent for grant of permission for laying of pipeline through private property and the same is not being disposed of. Petitioner made another representation on 17.08.2016. But no orders are passed on the same. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Revenue brought to my notice that the 3rd respondent has no power for granting permission to lay a pipe line through the private property. Even from the writ petition, it is not clear as to what relief, petitioner is seeking.

Learned counsel for the petitioner not brought to my notice under which provision of law, the 3rd respondent is empowered to grant permission for laying of pipeline through private property and he has also not made the person as party from whose land, the petitioner is seeking to lay the pipeline. In view of the above, I do not see any merit in the writ petition. Accordingly, the writ petition is dismissed. No costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
