HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Contempt Case No. 717 of 2017 Order:

This Contempt Case is filed alleging non-implementation of the order in W.P.No.28464 of 2015 dated 12.09.2016, whereunder this Court disposed of the Writ Petition in the following terms. "In the circumstances, this Writ Petition is disposed of giving liberty to the petitioner to submit a representation, detailing the treatment meted out to similarly placed persons, within a period of fifteen (15) days from the date of receipt of a copy of this order, and respondent No.2 shall place the matter before the Selection Committee for its consideration and review of the case of petitioner. The Selection Committee shall review the case of petitioner in accordance with law within a period of three (3) months thereafter and pass appropriate orders. No order as to costs."

Now, a counter affidavit is filed by the respondent stating that after considering the representation of the petitioner dated 28.10.2016, the matter was placed before the Selection Committee. The departmental Selection Committee which met on 01.03.2017 came to the conclusion that the petitioner was considered as unfit for the post of Deputy Superintendent (T) on promotion as he secured less than 50 qualifying marks. The marks secured by each candidate are also given in the said proceedings.

In view of the same, this Court sees no reason to continue the present contempt proceedings. However, liberty is given to the petitioner to agitate his rights, if he is aggrieved, in appropriate proceedings.

The Contempt Case is, accordingly, closed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous applications pending in this Contempt Case, if any, shall stand closed.
