THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.35057 OF 2016 ORDER: (per Hon'ble the Acting Chief Justice Ramesh Ranganathan) Sri Ch. Venkat Raman, Learned Counsel for the petitioner, is not able to show as to how Sections 142, 142-A, 143 and 145 of the Negotiable Instruments Act affects the petitioner's rights as on date. The validity of these provisions is under challenge in this Writ Petition on the premise that application of these provisions would affect the petitioner later during the course of trial.

As this Court would not decide academic issues, it is open to the petitioner to invoke the jurisdiction of this Court under Article 226 of the Constitution of India, as and when he is adversely affected by the application of these provisions. Leaving it open for him to do so, the Writ Petition is dismissed as premature. The miscellaneous petitions pending, if any, shall be closed. No costs.
