This writ petition was filed seeking a relief against the Bharat Sanchar Nigam Limited.
In terms of the Notification dated 31.10.2008 issued under subSection (2) of Section 14 of the Administrative Tribunals Act, 1985, the Central Government conferred jurisdiction from the said date on the Central Administrative Tribunal to decide all pending service disputes relating to the Bharat Sanchar Nigam Limited. In the light thereof, the jurisdiction of this Court under Article 226 of the Constitution to deal with the matter as the Court of first instance is ousted in the light of the law laid down by the Supreme Court in L. CHANDRA KUMAR V/s. UNION OF INDIA[1].
The Registry is therefore directed to transmit this case to the Central Administrative Tribunal, Bench at Hyderabad, within 15 days from today. All the issues raised in this writ petition are left open. ______________________ SANJAY KUMAR, J 16th SEPTEMBER, 2015 Svv [1] (1997) 3 SCC 261
