O R D E R

In a suit for recovery of amount based on promissory note, after evidence of the plaintiff and when the matter is coming up for further evidence of the defendant, the defendant filed the present application seeking permission to file additional chief affidavit to take a plea that as on the date of execution of the promissory note, he was on duty and hence there was no possibility for him to execute the sale deed and sought to rely on the certificate issued by his higher official. As the said plea was not taken in the written statement filed by the defendant, the trial court, by the impugned order, rejected the relief sought for by the petitioner/defendant and having regard to the facts and circumstances, I do not find any reason to interfere with the impugned order and the revision is devoid of any merit and the same is dismissed.
