THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.8265 of 2019 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioners/A2 to A4, seeking to grant anticipatory bail in Cr.No.216 of 2019 on the file of Aswaraopet Police Station, Bhadradri-Kothagudem District, registered for the offences under Section 304-B IPC read with Section 34 IPC.

Heard learned counsel for the petitionerd/A2 to A4, learned Additional Public Prosecutor representing the respondent-State and perused the record.

The case of the prosecution is that the marriage of the daughter of de-facto complainant was performed with A1 on 26.04.2019 and after some time, A1 along with A2 to A4 used to harass his daughter mentally and physically by demanding additional dowry and pressurizing her to sell Ac.0.5 acre of land, and that on 06.11.2019 at about 12.00 hours, one person informed the de-facto complainant that his daughter fell in well accidentally and died. 4.
Learned counsel for the petitioners/A2 to A4 submits that the petitioners are innocent of the alleged offences as they are residing far away from A1 and the deceased. He further submits that the allegations made in the complaint are all concocted and they are nothing to do with the alleged offences. He further submits that the petitioners have been falsely implicated in order to settle the
personal scores of the de-facto complainant. He further submits that the entire investigation is completed, except filing of the charge sheet. He further submits that the petitioners are law abiding citizens and they shall cooperate with the investigation and they shall abide by any condition imposed by this Court. 5.
Learned Additional Public Prosecutor opposed the relief sought in the petition.

As seen from the contents of the FIR, there are specific allegations against the petitioners that they have harassed the deceased by demanding additional dowry and that the death has occurred in unnatural circumstances in the house of her in-laws, within seven years of her marriage. Thus, view of the nature of allegations leveled against the petitioners/A2 to A4 and their alleged involvement in the crime, this Court is not inclined to grant anticipatory bail to them and their prayer for anticipatory bail is refused.

Hence, the Criminal Petition is dismissed.

Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
