This writ petition is filed under Article 226 of the Constitution of India to declare the letters issued by the 1st respondent vide Lr.F.No. AICTE/AB/SCR/PID1-17293845/ 2018-19, dated 07.12.2017 and Lr.No. AICTE/AB/SCR/PID 1-17293845/2018-19, dated 12.04.2018, as illegal and arbitrary and consequently to set aside the same and to direct the 1st respondent to permit admission into the Ambedkar Institute of Management Studies, Visakhapatnam to admit students for PGDBM course for the academic year 2018-19.
2. Learned counsel for the petitioner submits that though petitioner's institution complied with deficiencies, without taking the same into account, impugned order is passed and that they have made three representations dated 17.04.2018, 21.05.2018 and 14.06.2018 to the authorities after passing the impugned order stating that they have complied with the objections. He further submits that the petitioner is not questioning the power of the authority. The only grievance of the petitioner is that the representations filed by the petitioner have not been considered and disposed of.
3. On the other hand, Mr.K.Ramakanth Reddy, learned standing counsel basing on the counter-affidavit submits that they have not received the representations.
4. Learned counsel for the petitioner submits that the institution has been running for long, that they will make fresh representation to the competent authority pointing out that they have complied with deficiencies in the impugned order, dated 12.04.2018.
5. In view of the same, liberty is given to the petitioner to make a representation to the competent authority within a week from today and on such representation, the competent authority is directed to consider the same and take appropriate action in accordance with law.
