HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.8202 OF 2019 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure seeking quashing of the proceedings in C.C.No.882 of 2017 on the file of the I Additional Judicial First Class Magistrate at Khammam.

A charge sheet came to be filed against the petitioner/A-2 for the offences punishable under Sections 494, 294(B) and 506 read with Section 34 of the Indian Penal Code. Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioner/A-2 restricts his prayer seeking dispensation of the presence of the petitioner/A-2 before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioner/A-2 is not in dispute, her presence in the above C.C. may not be necessary on every date of adjournment. Having regard to the facts and circumstances of the case, the personal appearance of the petitioner/A-2 in C.C.No.882 of 2017 on the file of the I Additional Judicial First Class Magistrate at Khammam, is hereby dispensed with except on the dates when her presence is specifically required by the Court. With the above direction, the Criminal Petition is disposed of.

Miscellaneous applications, if any, pending shall stand closed.
