ORDER:
The purported inaction of respondent No.1 in disposing of the petitioner's appeal bearing No.47577 of 2010 is questioned in this writ petition. The petitioner suffered an order of eviction at the hands of respondent No.3 on 30.12.2006 in O.A.No.117 of 2002. Feeling aggrieved thereby, the petitioner approached respondent No.1 by way of revision. The said revision petition having been dismissed on 04.05.2010, the petitioner filed the purported appeal before respondent No.1 under Section 93 of the Andhra Pradesh Charitable and Hindu Religious Institutions Act, 1987 (for short 'the Act'). The grievance of the petitioner is that the so called appeal is not being disposed of by respondent No.1.
At the hearing, upon realizing that the so called appeal before respondent No.1 is not maintainable, Ms.T.V.Sridevi, learned counsel for the petitioner, has requested for permission of the Court to withdraw the writ petition, with liberty to the petitioner to avail appropriate legal remedy against the order of respondent No.3 ordering his eviction. The Writ Petition is, accordingly, dismissed as withdrawn, with liberty to the petitioner in terms of the prayer made. As a sequel to dismissal of the writ petition, W.P.M.P.No.4441 of 2016 filed by the petitioner for interim relief shall stand dismissed as infructuous.
