HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24501 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of respondents 3 and 4 in calling the petitioner to their police stations unnecessarily and entering into civil dispute i.e., house property, without having any valid reason and without registering any crime, as arbitrary and illegal.

Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.

Learned Assistant Government Pleader for Home produced written instructions, wherein it is stated that basing on the complaint of one Vara Lakshmi, a case in Crime No.42 of 2018 was registered against the petitioner for the offences punishable under Sections 447 and 506 read with 34 IPC of Kundurpi Police Station on 10.06.2018. It is stated that the police after completion of investigation, filed charge sheet on 24.07.2018 before the Judicial Magistrate of First Class, Kalyandurg. It is further stated that except registering the aforesaid crime against the petitioner, the respondent-police are not interfering with the civil disputes and they never called the petitioner to settle the civil disputes.

Recording the statement made by learned Assistant Government Pleader for Home, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
