The present writ petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to declare the action of the respondents 2 to 5 in not taking any further action against the respondents 6 to 8, pursuant to the F.I.R. No.186 of 2019, dated 01.08.2019 on the file of the Bibinagar Police Station, Bhongiri Rural, as being illegal and arbitrary.
Heard Sri V.V.N. Narayana Rao, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents 1 to 5.
The learned Assistant Government Pleader for Home, on written instructions dated 20.12.2019, a copy of which is placed on the record of this Court, would submit that based on the complaint made by the petitioner, a case was registered in Crime No.186 of 2019 on the file of Bibinagar Police Station on 01.08.2019 and the 5th respondent-Station House Officer, Bibinagar, took up investigation in the matter. In the course of investigation, the 5th respondent authority examined LWs.1 to 6 and their statements were recorded. Notice under Section 41 (A) of Cr.P.C. was served to the accused No.1 on 05.08.2019.
The learned Assistant Government Pleader for Home further submits that as per the investigation done so far, prima facie case is not established against the remaining accused and after obtaining permission from the higher officials, the case will be finalized.
Having regard to the said submission, this Court is of the view that no further orders need be passed in this writ petition, except observing that the authority shall take steps to finalize the case as expeditiously as possible. Subject to the above observation, the writ petition is closed. However, there shall be no order as to costs.
