THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.8223 of 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/accused seeking to grant anticipatory bail in the event of his arrest in Crime No.41 of 2019 on the file of Mahabubabad Police Station, Mahabubabad District, registered for the offences punishable under Sections 409, 403 and 420 IPC.

Heard learned counsel for the petitioner, learned Additional Public Prosecutor appearing for the respondent-State and perused the record.

Earlier, the petitioner filed Crl.P.Nos.1680 of 2019 and 1991 of 2019 before this Court for the very same purpose. The said petitions were dismissed by orders dated 02.4.2019 and 22.4.2019 recording that the gravity of the offence is high and the matter requires custodial investigation. This Court finds no change of circumstances warranting any indulgence being shown to the petitioner at this stage.

The Criminal Petition is accordingly dismissed. However, the petitioner is directed to surrender before the Court concerned within ten days from the date of this order and move an application for bail, upon which, the Court below shall consider the same and pass appropriate orders in accordance with law, after giving due notice to the learned Public Prosecutor concerned.
