HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 23023 of 2003 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondent in removing the petitioner from service vide order dated 17.10.2003.

While admitting the writ petition, this Court granted interim suspension of the impugned orders vide order dated 03.11.2003 in WPMP No.28881 of 2003.

When the matter is taken up for hearing, learned counsel for the petitioner submits that by virtue of the interim orders granted by this Court, the petitioner was allowed to continue in service and he has retired from service on attaining the age of superannuation and, therefore, the cause in the writ petition does not survive for adjudication.

Recording the submission made by the learned counsel for the petitioner, the writ petition is dismissed as infructuous.
