HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.1152 of 2015 in Crl.P.No.1046 of 2015 and Criminal Petition No. 1046 of 2015 COMMON ORDER:

The de-facto complainant and his counsel Sri B.Muralidhar are present. Accused and their counsel Sri T.Prasanna Kumar are present.

On the report given by de-facto complainant the police of Bowenpally PS, Hyderabad registered FIR No.46 of 2013 against the accused for the offence under Section 384 r/w 34 IPC and investigation is stated to be pending.

The allegation is that the complainant purchased a cell phone from A1 through advertisement in OLX.com. He took the phone to home but he could not find A1 and after some time on 04.02.2015 he received a call from A2 who is police constable about the sale of cell phone and A1 and Univercell cell phone show room representative came to the office of the complainant and they threatened him and demanded money from him and caused embarrassment.

Now, the parties submitted that at the intervention of elders they have amicably settled their disputes and as such permission may be accorded to them to compound the offence and record the compromise and consequently proceedings in Cr.No.46 of 2015 of Bowenpally PS, Hyderabad may be quashed. Having regard to the above submission of the parties and

considering the fact that matter is purely a private case relating to purchase of cell phone and payment of the amount and also considering the fact that parties have amicably settled their disputes and as the defacto complainant states now there this is no threat from the accused and considering that no useful purpose will be served if the investigation is allowed to be continued and relying upon the decision reported in Gian Singh v. State of Punjab and another[1] this petition is allowed permission is granted to compromise the case and compromise is recorded and proceedings in Cr.No.46 of 2015 pending on the file of Bowenpally PS, Hyderabad are hereby quashed. In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
