HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.7411 of 2016 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue appearing for respondents.

In this Writ Petition, the petitioner has questioned the order dt.28-01-2015 passed by 4th respondent refusing to register a document.

The impugned order states that the document cannot be registered since it is prohibited under Section 22-A of the Registration Act, 1908. The order is cryptic and gives no reasons because Section 22-A of the said Act contains the several clauses and it is not mentioned which clause is applicable and for what reason.

Therefore, the impugned order is set aside and 4th respondent is directed to pass a fresh reasoned order giving specific reasons why he does not wish to register. He shall also pay costs of Rs.2,000/- (Rupees Two Thousand only) to the petitioner. This exercise shall be completed by 4th respondent within four weeks from the date of receipt of a copy of this order. No costs.

4. With the above directions, the Writ Petition is disposed of. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
