THE HON'BLE SRI JUSTI CE D.V.S.S.SOMAYAJULU SECOND APPEAL NO.9 9 7 OF 2 0 1 8 JUDGMENT:- This court has heard both learned counsel appearing for appellant and respondents.
The learned counsel for the appellant raised substantial questions of law and fact and points out that the decree of the first appellate court does not consider the implication of the death of 1st respondent-Pola Venkatappadu. The learned counsel says that the present 1st respondent/ appellant does not have any obligation to maintain the present 1st respondent out of his personal assets. The issue about the shares of the respective parties is also not decided. The learned counsel for the respondents also agrees that the matter should be revisited and that the shares of each of the parties and the consequential liability of the estate of the deceased to maintain daughter-in-law should be decided.
Therefore, the Second Appeal is allowed while remanding the matter to the lower appellate court for fresh disposal according to law. No costs. Miscellaneous Petitions pending, if any, shall stand closed in consequence. ______________________ D.V.S.S.SOMAYAJULU,J 26-07-2018 TSNR
