HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.24534 of 2018 ORDER:

The petitioners challenge notice dated 10.01.2018 as illegal, arbitrary and unconstitutional.

I have heard Mr.N.Shiva Reddy for a considerable length of time.

Prima facie, this Court is of the view that the notice is issued for correction or maintenance of an entry in the record of rights under ROR Act. The petitioners are entitled to file detailed reply and similarly the 3rd respondent is required to consider each one of the objections in the enquiry, he conducts in this behalf. Therefore, I am not persuaded to entertain the writ petition. However, to meet the ends of justice, the writ petition is disposed of by this order. (a) The petitioners are given liberty to file reply within two weeks from today by enclosing a copy of this order.

(b) The 3rd respondent is directed to consider all objections including the objection on the

jurisdiction of 3rd respondent to entertain the request for mutation.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
